Gay constitutional right
When the news broke that President Trump may get another Supreme Court nominee, the sky seemed to be falling in left-wing gay and transgender advocacy circles. The prospect of a conservative Supreme Court majority prompted an all-out meltdown among some onlookers. The organization is the largest group in the United States that claims to advocate for gay and transgender rights, but in practice, it acts as a de facto arm of the Democratic Party. This hysterical sentiment extended to the very top of the Democratic Party. If anything, gay and transgender rights advocates may simply have to achieve their reforms through the democratic process rather than have them imposed on the nation via judicial activism and unilateral fiat.

No, a conservative Supreme Court would not be ‘catastrophic’ for gay and transgender rights
T he United States has witnessed a remarkable shift in LGBTQ rights and visibility in the 50 years since the Stonewall uprising — and in just the last few years, LGBTQ people have won the right to marry, have hit a record high in representation on television and have seen the first openly gay major presidential candidate begin his campaign. And just as advocates fought their battle American culture, they also did so in the courts, including the U. Supreme Court. Over the last half a century, the court first denied and then affirmed that LGBTQ people have the right to consensual sex, and then the right to marry whom they choose. The first case will consider the dismissals of a county government employee and a skydiving instructor, who were fired for being gay. The second case will consider the case of a funeral home director, who was fired after coming out as transgender.

Gay Marriage Arguments Divide Supreme Court Justices
The untold story of the improbable campaign that finally tipped the U. Supreme Court. The county clerk, Gerald Nelson, refused to give it to them. Obviously, he told them, marriage was for people of the opposite sex; it was silly to think otherwise.
The first line of the U. Hodges, on the legality of same-sex marriage in the United States, is as breathtaking as it is legalistic. The Fourteenth Amendment requires a State to license a marriage between two people of the same sex and to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-State.
